Terms of Service

This document details the Terms of Service (ToS) of the GDQuest website (gdquest.com) and its subdomains (such as school.gdquest.com). It is systematically provided to each customer to allow them to place an order.
The document covers both the CGV (Conditions Générales de Vente, general sales conditions in English) and CGU (Conditions Générales d'Utilisation, general usage conditions in English) required by French law.

1. Definitions

  • Company designates the company SARL GDQuest, registered in France in the "Regsitre du Commerce et des Sociétés" (RCS, trade and companies registry in English) of Thonon-Les-Bains under the RCS number 908630312. The company's head office is located at 10 Avenue de Flery, 74500 Evian, France, and the company's VAT number is FR52908630312.
  • Website designates the GDQuest website, gdquest.com, and all the associated web pages and subdomains (for example, school.gdquest.com).
  • Customer designates any natural or legal person using the Website who places an order on the Website.

2. Purpose and scope

The Terms of Service described below detail the rights and obligations of the Company and the Customer for the purchase of any product provided on the Website.
Any order placed on the Website requires the Customer to explicitly accept these Terms of Service. By clicking the checkbox "I read and accept the Terms of Service" at checkout, the Customer adheres to and accepts these Terms of Service without restrictions.
The Company reserves the right to modify these Terms of Service at any time to comply with any new regulations or to improve the use of the Website.
The applicable Terms of Service will be those in effect at the date of the Customer's order.

3. Products

The products proposed by the Company are the ones listed on the Website. Each product comes with a page describing its content and means of access.
The Company may change products available for purchase at any time.
Even if the company changes products available for purchase, once they purchased a product, the Customer will still have access to the product through their user dashboard.

4. Prices

The applicable prices of products are the prices displayed on the Website at the time of the order and they include all applicable taxes (accounting for applicable VAT on the purchase date).
Unless otherwise indicated next to the product's price, listed prices are in US dollars (USD).
The Company reserves the right to change prices at any time. However, the price applicable to the Customer will always be the price displayed at the time the Customer places and validates an order.
Once the Customer has bought a product, any updates applicable to the pruchased version of the product come at no extra cost, even if the Company increases the price. Unless otherwise specified, this does not apply to different version releases or remakes of a product.

5. Placing Orders and Payment

Before placing an order, the Customer must create an account on the Website. The user account allows the Company and the Customer to keep track of orders and access products. User accounts are subject to the Company's Privacy Policy.
The payment of orders can be made using:
  • Credit cards.
  • Paypal.
  • Any other means of payment listed on the Website at the time of order as provided by the platforms Stripe or PayPal.
The Customer can place an order from any country supported by Stripe or PayPal. To learn about supported countries, please refer to the documentation of Stripe and PayPal:
To place an order, the Customer:
  • Adds one or more products to their shopping cart.
  • From their shopping cart, they select their payment method and enter the required information.
  • The following step allows the Customer to review their order and provides a checkbox to accept the Terms of Service before proceeding with payment.
  • The customer receives access to the purchased product following payment. Access to the product cannot be provided prior to payment confirmation.
The Customer will receive a purchase receipt to the email associated with their account. At any time, they will also be able to access past receipts from their user dashboard.
The provided data and the receipt constitute proof of the transaction.

6. Refund Policy

The Customer can request a refund for their purchase within 60 days from the time of payment.
The paid amount will be refunded in full without fees through the means of payment used by the Customer for the purchase. Upon getting a refund, the Customer will immediately lose access to the refunded products.
To request a refund, the customer can email the Company at support@gdquest.com or using our Contact Form and provide the necessary details to request a refund:
  • A copy of their purchase receipt attached to the email.
  • The email address associated with the customer's user account on the Website.
  • The product(s) for which the Customer requests a refund.

The products purchased by the Customer are available for as long as the Website and the Company exist.
The Website is hosted using two service providers: Vercel, and Supabase.

9. Licenses

By purchasing a product from the Company, the Customer is given an individual license to use the product themself on any number of devices. The Customer is however not entitled to share, copy or distribute the product.
Unless otherwise stated in the product, all the software included in the Company's products or on which the Company bases its products, including the Godot game engine, Godot projects, assets included in Godot projects, Godot add-ons, are open-source and available under the MIT license.
Unless otherwise stated on the corresponding page, the Website and all of the Website's content provided by the Company, such as, but not limited to, videos, images, interactive exercises on the Website, and text, is all rights reserved to GDQuest.

10. Warranties

10.a. Warranty for visible and hidden defects (garantie légale de conformité et garantie légale des vices cachés)

All of the products provided by the Company are covered by the legal warranty stipulated in articles 1641 and following of the French Civil Code.
In the event of non-conformity of a product sold by the Company, the Customer may request a full refund within the timeframes applicable by French laws.

10.b Warranty for confirmity of digital services

The Company provides digital services (services numériques in French) for learning game development.
These digital services are covered by the legal warranty stipulated in decree n° 2022-946 of the 29th of June 2022. This legal warranty covers digital services except for open-source software provided by the Company, including, but not limited to, copies of the Godot game engine, Godot projects, Godot addons, and any open-source portions of the Website.
The Customer can learn more in the legal frame below. We provide an English translation for the Customer's convenience, followed by the original text in French.
The Customer understands and accepts that the English translation is only provided for accessibility and may be inaccurate, and that the legal source of truth is the French version provided below.

Consumers have a period of two years from the reception date of the digital content or service to invoke the legal warranty of conformity in the event of a lack of conformity. During a period of one year from the reception date, the consumer is only required to prove the existence of the lack of conformity, and not the date of its appearance.
The legal warranty of conformity includes the obligation to provide all updates necessary to maintain the conformity of the digital content or service.
The legal warranty of conformity entitles the consumer to have the digital content or service brought into conformity without undue delay following their request, at no cost and without major inconvenience to them.
The consumer may get a partial refund by keeping the digital content or digital service, or they may terminate the contract and get a full refund in exchange for relinquishing the digital content or digital service, if :
1° The professional refuses to bring the digital content or service into conformity;
2° The conformity of the digital content or service is unjustifiably delayed;
3° The digital content or service cannot be brought into conformity without incurring costs to the consumer;
4° Bringing the digital content or service into conformity causes major inconvenience to the consumer;
5° The non-conformity of the digital content or service persists despite the professional's unsuccessful attempt to bring it into conformity.
The consumer is also entitled to a partial refund or cancelation of the contract where the lack of conformity is so serious as to justify immediate partial refund or cancelation of the contract. In such cases, the consumer is not obliged to ask for the digital content or service to be brought into conformity beforehand.
In cases where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for payment of a price.
Any period of unavailability of the digital content or service for the purpose of bringing it back into conformity suspends the remaining warranty period until the digital content or service is made in conformity again.
The rights mentioned above result from the application of articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.
Any professional who obstructs the implementation of the legal guarantee of conformity in bad faith is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual sales (article L. 242-18-1 of the French Consumer Code).
Consumers are also covered by the legal warranty for hidden defects under articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This warranty entitles the consumer to a partial refund if the digital content or service is kept by the consumer, or to a full refund if the consumer renounces access.

Le consommateur dispose d'un délai de deux ans à compter de la fourniture du contenu numérique ou du service numérique pour obtenir la mise en œuvre de la garantie légale de conformité en cas d'apparition d'un défaut de conformité. Durant un délai d'un an à compter de la date de fourniture, le consommateur n'est tenu d'établir que l'existence du défaut de conformité et non la date d'apparition de celui-ci.
La garantie légale de conformité emporte obligation de fournir toutes les mises à jour nécessaires au maintien de la conformité du contenu numérique ou du service numérique.
La garantie légale de conformité donne au consommateur droit à la mise en conformité du contenu numérique ou du service numérique sans retard injustifié suivant sa demande, sans frais et sans inconvénient majeur pour lui.
Le consommateur peut obtenir une réduction du prix en conservant le contenu numérique ou le service numérique ou il peut mettre fin au contrat en se faisant rembourser intégralement contre renoncement au contenu numérique ou au service numérique, si :
1° Le professionnel refuse de mettre le contenu numérique ou le service numérique en conformité ;
2° La mise en conformité du contenu numérique ou du service numérique est retardée de manière injustifiée ;
3° La mise en conformité du contenu numérique ou du service numérique ne peut intervenir sans frais imposés au consommateur ;
4° La mise en conformité du contenu numérique ou du service numérique occasionne un inconvénient majeur pour le consommateur ;
5° La non-conformité du contenu numérique ou du service numérique persiste en dépit de la tentative de mise en conformité du professionnel restée infructueuse.
Le consommateur a également droit à une réduction du prix ou à la résolution du contrat lorsque le défaut de conformité est si grave qu'il justifie que la réduction du prix ou la résolution du contrat soit immédiate. Le consommateur n'est alors pas tenu de demander la mise en conformité du contenu numérique ou du service numérique au préalable.
Dans les cas où le défaut de conformité est mineur, le consommateur n'a droit à l'annulation du contrat que si le contrat ne prévoit pas le paiement d'un prix.
Toute période d'indisponibilité du contenu numérique ou du service numérique en vue de sa remise en conformité suspend la garantie qui restait à courir jusqu'à la fourniture du contenu numérique ou du service numérique de nouveau conforme.
Les droits mentionnés ci-dessus résultent de l'application des articles L. 224-25-1 à L. 224-25-31 du code de la consommation.
Le professionnel qui fait obstacle de mauvaise foi à la mise en œuvre de la garantie légale de conformité encourt une amende civile d'un montant maximal de 300 000 euros, qui peut être porté jusqu'à 10 % du chiffre d'affaires moyen annuel (article L. 242-18-1 du code de la consommation).
Le consommateur bénéficie, en outre, de la garantie légale des vices cachés en application des articles 1641 à 1649 du code civil, pendant une durée de deux ans à compter de la découverte du défaut. Cette garantie donne droit à une réduction de prix si le contenu numérique ou le service numérique est conservé ou à un remboursement intégral contre renonciation au contenu numérique ou au service numérique.

11. Liability (Responsabilité)

The Company is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet network, such as loss of data, intrusion, viruses, disruption of service, or other involuntary problems.
The Customer is responsible for all content posted and activity that occurs under their account (even when content is posted by other people who were given access to the Customer's account by the Customer).
The Customer may not use the Website for any illegal purpose or to violate any laws in your jurisdiction (including but not limited to copyright laws).
The Customer's account may only be used by one person – a single account shared by multiple people is not permitted.
The Company cannot be held liable in the event that the website is temporarily unavailable due to, but not exclusively, a case of force majeure, maintenance of the web hosting services, a modification of the website, a network failure, a power cut, or a configuration issue on the Customer's computer.
All content posted on the Website by the Customer must comply with French laws.
The Company claims no intellectual property rights over the material the Customer uploads to the Website.
The Company does not pre-screen content, but reserves the right (but not the obligation) in their sole discretion to refuse or remove any content that is available via the Website.

13. Communication and Participation in the Community

Any communication on the Website and with the Company is subject to the Company's Kind Communication Guidelines.
Verbal, physical, written or other abuse (including threats of abuse or retribution) of any Website customer, Company employee or officer will result in immediate account termination.

14. Dispute Resolution and Jurisdiction

These Terms of Service are governed by French law. For all disputes and litigation, the competent tribunal is the "Tribunal de commerce de Thonon-les-Bains" (Commercial court of Thonon-les-Bains in English):
